1. Who this covers

This policy applies to everything Chasing Optimum operates:

  • the website and web app at chasingoptimum.com, including the online store;
  • the Chasing Optimum iOS app;
  • the Chasing Optimum Android app.

They are one product. You sign up on one and sign in on the other with the same account, and your information is held in one place. Where something applies to only one platform, this policy says so.

2. Information we collect

2.1 Account information

Your email address, and your first and last name if you give them. Sign-in is passwordless — a one-time code sent to your email — and is handled for us by Clerk. We never hold a password for you. You may also add a profile photo, a location, a profession and social links.

2.2 Health and fitness information

This is the heart of the app, and most of it is sensitive information under the Australian Privacy Act 1988 and special-category data under the GDPR. You choose to provide all of it:

  • daily check-ins and completed tasks in the 30 Day and 60 Day Challenges;
  • food logs, including photographs of meals you scan, and the resulting nutrition and macronutrient estimates;
  • body measurements — weight, waist, hours of sleep — and self-rated assessment scores;
  • mood entries and any notes you attach to them;
  • progress photographs you upload;
  • workout records — which sessions you started and finished, and the weight and repetitions you log for each exercise;
  • messages you send to the in-app AI coach, which frequently contain health information.

We collect this only because you enter it, and we use it only to run the features you are using. See section 4 for consent.

2.3 Community information

If you use the community you also create:

  • posts, comments, replies and reactions;
  • direct messages to other members;
  • your member profile and, if you choose, a listing in the member business directory;
  • reports you submit about other members' content.

Members cannot upload video. Video in the app is published by Chasing Optimum staff and coaches only.

2.4 Purchases

Whether you own the 60 Day Challenge, and the state of your membership. Card details are handled by Stripe (challenge and membership) and Shopify (physical products) and are never seen or stored by us. For physical orders we receive your name, delivery address, contact details and order contents, because we fulfil, ship and handle returns ourselves.

2.5 Notifications

If you allow notifications, a push token for your device, so we can tell you when a coach posts. You can switch this off in your device settings at any time.

2.6 Technical information

Standard server logs kept by our hosting providers, and cookies described in section 10.

2.7 What we do NOT collect

  • We run no third-party advertising and include no advertising SDK.
  • We include no third-party analytics SDK and no crash-reporting SDK.
  • We do not collect your precise location, your contacts, your photo library beyond the images you deliberately choose, your health records from Apple Health or Google Fit, or any biometric identifiers.
  • We do not sell your information, and we never have.

3. How we use your information

  • To provide the features you use — tracking, logging, coaching, community, purchases and delivery.
  • To show you your own history and progress.
  • To send transactional email (sign-in codes, order and billing notices, including the pre-charge notice required before a membership renewal).
  • To send push notifications you have opted into.
  • To keep the community safe — reviewing reports, moderating, and enforcing our Terms of Use.
  • To meet our legal obligations, including under the Australian Consumer Law.

We do not use your health information for advertising, profiling, or automated decisions that produce legal effects.

Australian privacy law requires your consent before we collect sensitive information, which includes health information. You give that consent by choosing to enter health and fitness data into the app. You can withdraw it by deleting the data, or by deleting your account (section 9).

You are never required to enter health information to use the app; every tracking feature is optional.

5. Who we share information with

We share only what a provider needs to do its job. We do not sell your data.

We may also disclose information where the law requires it, to enforce our Terms, or to protect the safety of a person.

6. Artificial intelligence features

Two features send your content to a third party:

  • Meal scanning sends the photograph to Google's Gemini model.
  • The AI coach sends your messages, and a summary of your recent activity, to OpenAI.

Nothing either feature produces is medical, dietary or professional advice. Nutrition estimates are approximations and are frequently wrong. See the Terms of Use.

7. What other people can see

Anything you post in a community space, a channel, or the member directory is visible to other signed-in members — including your display name and profile photo. Direct messages are visible to you and the recipient, and to our moderators where a message is reported or where we are required to review it.

Your health data, food logs, measurements, mood entries and progress photographs are private to you and are not shown to other members.

8. Where your information is stored

Our database and file storage are operated by Convex, and our other providers operate their own infrastructure. Some of these providers store and process data outside Australia, including in the United States.

By using the app you consent to that transfer. We take reasonable steps to ensure our providers protect your information to a comparable standard.

9. Your rights, and deleting your account

You may:

  • see and correct most of your information directly in the app;
  • delete individual entries — a food log, a mood entry, a progress photo — at any time;
  • delete your entire account from Settings in the mobile app, which removes your account and the personal information associated with it;
  • ask us for a copy of your information, or ask us to correct or delete it, by emailing support@chasingoptimum.com.

We respond to requests within a reasonable time and in any case within the period required by law.

If you are in the EU or UK you also have rights of portability, restriction and objection, and a right to complain to your local supervisory authority. If you are in California you have rights of access and deletion, and a right not to be discriminated against for exercising them.

10. Cookies

On the website we use a small number of strictly necessary cookies: a session cookie set by Clerk to keep you signed in, a shopping-cart cookie, and a cookie remembering your light or dark theme. We use no advertising or tracking cookies. The mobile apps do not use cookies.

11. Children

The app is not intended for anyone under 18, and we do not knowingly collect information from a person under 18. If you believe a child has given us information, email support@chasingoptimum.com and we will delete it.

12. Security

We use reputable providers, encrypted connections, and access controls limiting who on our team can see member data. No system is perfectly secure, and we cannot guarantee absolute security. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme requires.

13. Changes

We will post any change on this page and update the date at the top. If a change is significant we will tell you in the app or by email.
